The auto insurance laws in Oregon are unique. Unlike the majority of other states, which follow either a tort or no-fault system, Oregon uses a combination of both. After being hurt in a crash caused by a drunk driver, you can file a claim with your own insurance company regardless of who was at fault. By claiming your personal injury protection (PIP) benefits, you can receive up to $15,000 paid toward your medical expenses and if you carry higher PIP limits on your insurance policy you can recover up to the maximum of those limits.  You can also recover 70% of your lost wage through your PIP benefits, if you are off of work for more than 2 weeks.  The maximum PIP will pay, however, in one month is $3,000.00 and will only pay for up to 52 weeks.
