An accident often occurs in just a fraction of a second. But the aftermath can last a lifetime. Many people are left seriously injured following an accident. This means they not only face potentially thousands of dollars in medical bills, but also a reduction in their income as they are unable to resume working following their accident. On top of that, there is also the ongoing physical and psychological trauma that is part of the recovery process.

Some accidents are single car accidents.  Most accidents we represent are the result of negligent acts by another at-fault driver.  If you have been injured in such an accident, you have legal options for seeking compensation for all of your losses. Lance D. Youd is a Salem personal injury lawyer with three decades of experience in representing accident victims. He understands the difficulty that victims face in rebuilding their lives following a preventable accident. Which is why he will make every effort to ensure those who were responsible are held legally accountable.

Negligence and Personal Injury Claims in Oregon

Oregon personal injury claims are rooted in the concept of negligence. Negligence requires proof of three things:

  1. The defendant owed the plaintiff a duty of care.
  2. The defendant breached that duty of care by acting or failing to act in some way.
  3. The defendant’s breach caused some measurable injury to the plaintiff.

A duty of care is often something as simple as following the traffic laws to avoid causing a car accident. But no matter the situation, the law looks at whether or not the defendant’s actions under the circumstances were “reasonable” to meet the required duty of care. For instance, in a slip and fall case, the legal question is generally whether the property owner acted reasonably in identifying and removing any potential hazard that could injure a customer.

Negligence plays a critical role in many types of personal injury cases. Among the types of claims attorney Lance D. Youd handles on behalf of clients are the following:

  • Car Accidents
  • Bicycle Accidents
  • Motorcycle Accidents
  • Commercial Vehicle & Truck Accidents
  • Uninsured and Underinsured Motorist Accidents
  • Wrongful Death

frequently asked questions

Many people who have suffered an accident or an injury wonder if they should hire a personal injury attorney. Bereaved families who have lost a loved one in an accident may question whether they should get a lawyer. Regardless of the extent of the damage or injury, you should almost always hire an attorney.

Why? When injuries or accidents occur, insurance companies generally receive a claim. They almost always move immediately to limit the number of damages they have to pay. Unfortunately, this can put you at risk and limit the monetary amount and justice you’re entitled to.

A personal injury attorney should be called immediately following an accident or personal injury before you file a claim. Your personal injury lawyer will help preserve evidence and collect the information you need to properly file a claim and get the compensation you deserve. Before you file a claim, it is best to hire a personal injury lawyer to file the claim and discuss your case with the insurance adjusters. Insurance companies may use any conversations you have with them or the liable party against you, so refrain from speaking to either without your attorney present.

When working with the personal injury attorney at Youd Law, you have a team of paralegals and legal assistants working on your behalf. How will I cover my medical expenses
from my vehicle accident or personal

A car accident can result in adverse effects to your health. Any injuries you sustain in a car accident may require urgent medical attention, which could put undue and unexpected financial strain on you and your family. The best way to recover the expenses as a Oregonian in Salem is through filing a personal injury or car accident lawsuit. How do you go about this?

In Salem, many competent attorneys can help you through the legal process. They assist in many ways by gathering and compiling evidence, finding witnesses, and court representations. When filing for a claim, these legal minds will make everything follow the correct order.

A Salem Personal Injury Lawyer will fight for your maximal compensation by ensuring accuracy in the claim filing. They also protect you from any luring from the insurance company aimed at lowering the compensation amount.

An out-of-court settlement is an effective way to get compensation. It’s ordinarily time-saving as compared to going to the courts. Besides, both you and the other party need to be cooperative for things to work. Consider doing the proper settlement valuing for the compensation to be comprehensive and fair.

This is where you include the current medical expenses and the future ones likely to occur. It is essential, especially when the injuries are significant. Add physical therapy treatment expenses.

After incurring medical expenses resulting from an accident, there is a way to cover the losses. One of them is through filing a claim with the help of a personal injury lawyer. The other worthy option is engaging in an out-of-court settlement.

How can I pay my bills when an injury
has forced me out of work?

Leaving work due to an injury can be painful. It brings some reduction in income as you can no longer receive your usual benefits. Seek justice against the party that caused your injuries. Consider filing the right lawsuit. Having a lawyer makes the legal process smooth.

You may consider filing a third-party insurance claim with the insurance of the at-fault party. For the filing process to be successful, consider finding a lawyer by your side. As a Oregonian in Salem, find competent attorneys who can make your mission at the insurance materialize. A Salem Personal Injury Lawyer knows what leads to maximization of the compensation. They do this by ensuring high accuracy in the evidence gathering.

Filing a first-party insurance claim is another viable option. This is where you file the claim with your own insurance company. It may seem impossible to benefit from it as you’re not the cause of the accident. The truth is, there is some compensation you may get from it. This can cushion you during hard times.

Your finances will shift to other expenses and primarily the medical bills by catering for the auto repairs. For maximal compensation, it’s significant to make every piece of information display high precision. With this, your insurance company will not have a reason to lower the compensation amount.

Being forced out of work by an injury is the last thing anyone wants. Filing a lawsuit is necessary as this is where the compensation will come from. You have an option of filing with your insurance company or that of the at-fault party.

Who will take care of me while I recover?

An accident can leave you bed-ridden as well as cause significant and unexpected financial problems. Your recovery time depends on the extent of your injuries. Medical teams are pivotal at this time since they do the proper examination and offer treatment to stabilize your health.

Medical attention also offers guidance on the need for therapy services. For example, you could require undergoing post-traumatic stress disorder (PTSD) therapy sessions or even physical therapies. Another significant thing with the medical services is that you will get a medical report.

Your Salem Personal Injury Lawyer will use this as part of the evidence. The medical information will accurately picture the injuries inflicted on you when doing the claim filing or during the court process.

Hiring a lawyer first thing after the accident is crucial. Even as you recover, such law experts know which ways to protect your interest. For instance, they guide you on why it’s critical to avoid interaction with the at-fault party. Additionally, an advocate ensures that as you recover, the insurance company knows about the accident.

Another piece of advice you get is on why you ought to cut ties with the insurance adjuster. Your lawyer may push the claim filing soon with your insurance company so that the compensation can arrive early. During such times, the insurance agents could try to reach out to you and make cash offers. Such alternatives always aim to lure you into a trap; hence, your advocate will always talk.

Besides medical attention by a doctor, you need a legal presence that protects your interests. An advocate will shield you from the insurance adjuster’s advances. Besides, you get guidance on how to conduct yourself, including avoiding conversations with the at-fault party.

Many mistakes are made and timely wins are missed when injured individuals attempt to fight the at-fault insurance company and their attorneys on their own. Our personal injury lawyer, Lance Youd, will provide guidance and interface with the insurance company on your behalf. There are many variables that factor into a successful outcome and your personal injury lawyer can help you manage the various aspects that will help your case, whether it is advising you on how to preserve evidence, collecting information to file a claim properly, or discussing your case with insurance adjusters.

Our expert Lance Youd’s legal advice can help mitigate any risks involved as you bring your claim and throughout your case.

Discussing the details of your claim with our personal injury lawyer, Lance D. Youd will also help you determine whether bringing a personal injury claim is the best course of action. For instance, minor fender benders that only cause cosmetic damage to your vehicle may not require a personal injury attorney. On the other hand, major car accidents, traumatic injuries, impaired driving accidents, other serious claims, even soft tissue injuries typically require the assistance of an attorney.

Am I entitled to any compensation for
my injuries?

If you are involved in an injury-related incident, you may be entitled to compensation. What is significant is following the correct legal process. The law clarifies the right to sue the at-fault party for the loss or injuries since the accident. However, you need to have the proper evidence of negligence that caused the accident.

After the slip-and-fall, motorcycle, vehicle accident, there is a need to seek medical attention to deal with the injuries. The medical services will tend to drain your finances hugely significantly when the accident impact is significant. The neck and brain injuries are generally costly and need long-term treatment for a full recovery.

Federal personal injury laws are clear on your eligibility for compensation after an injury. In Oregon, a Salem Personal Injury Lawyer guides on which ways to prepare for the lawsuit. You may get guidance on how best to document evidence.

In the court proceedings, your entitlement right will see the jury try to understand the nature of the accident. This is where there will be the determination of the at-fault party using the evidence and statements presented at the courts. If the court finds the liable party responsible for what happened to you, it will pass a ruling in your favor. This is what makes you get the much-needed compensation.
After getting injuries as a result of the recklessness of another party, you are eligible for compensation.

What is essential is having a lawyer handle your lawsuit. It helps in gathering the correct information to show how the at-fault party brought about the accident.

What Compensation Can I Recover in an Oregon Personal Injury Case?

In any personal injury lawsuit, the plaintiff is seeking damages from the defendant. Damages can be broadly broken down into three categories:

  • Economic damages reflect the plaintiff’s out-of-pocket losses and expenses. Medical bills are perhaps the most common type of economic damages in a personal injury case, followed by lost income. For example, if you had to miss a week from work due to a car accident caused by a reckless driver, you could seek economic damages to cover those lost wages. Economic damages can also cover projected future losses, such as the long-term costs of your medical care and rehabilitation, as well as projected loss of future income due to an accident-related disability.
  • Non-economic damages are a subjective measure of a plaintiff’s real (but difficult to measure) losses. Non-economic damages are often referred to as “pain and suffering.” But such damages can also include compensation for emotional distress and disfigurement. Oregon law caps non-economic damages in personal injury cases at $500,000. But in 2020, the Oregon Supreme Court held that cap was unconstitutional in personal injury cases.
  • Punitive damages are not meant to compensate the plaintiff for their losses. Rather, they are meant to punish defendants in cases where they have acted maliciously or with “outrageous indifference” to others. Punitive damages are not awarded in most personal injury cases, and when they are, the State of Oregon is entitled to 70 percent of the proceeds.

What If I’m Found Partly Responsible for My Injuries?

A common question many accident victims have is, “What if I was partially at-fault for what happened? Can I still sue the other party for damages?” The answer is “yes.” Oregon follows what is known as a modified comparative negligence rule in personal injury cases, which means that even if the plaintiff was partly responsible for their injuries, they are often still able to recover some damages from a negligent defendant.

Comparative negligence basically means that a court will apportion fault for an accident among all of the responsible parties, including the plaintiff. This apportionment is done on a percentage basis. The court will then determine the total amount of the plaintiff’s damages and reduce them based on their percentage of fault.

For example, say a plaintiff and a defendant are involved in a car accident. The plaintiff sues the defendant for damages. The defendant argues the plaintiff actually caused the accident. After hearing the evidence, the jury decides the defendant was 70 percent at-fault and the plaintiff was 30 percent at-fault. If the plaintiff’s total damages from the accident was $100,000, the defendant would only have to pay $70,000 of that amount.

However, Oregon does bar a plaintiff from recovering any damages if their share of the fault exceeds 51 percent. So if the jury found the plaintiff was 70 percent at-fault, the defendant would not have to pay anything at all.

How Long Do I Have to File a Personal Injury Claim?

All lawsuits must be filed within a period of time known as the statute of limitations. In Oregon, the statute of limitations with respect to personal injury claims is generally two years. This means that from the date of an accident, you have 2 years to identify and sue the responsible parties.

This is not as much time as you might think. Personal injury cases often require a significant amount of preliminary investigation and dealing with insurance companies before any formal legal action can be taken. So it is important that you engage a qualified Salem personal injury attorney as early as possible in the process to preserve and protect your rights under the law. If you have been injured in an accident and need legal advice or representation, contact attorney Lance D. Youd today to schedule a case review.
