What Compensation Can I Recover in an Oregon Personal Injury Case?

In any personal injury lawsuit, the plaintiff is seeking damages from the defendant. Damages can be broadly broken down into three categories:

  • Economic damages reflect the plaintiff’s out-of-pocket losses and expenses. Medical bills are perhaps the most common type of economic damages in a personal injury case, followed by lost income. For example, if you had to miss a week from work due to a car accident caused by a reckless driver, you could seek economic damages to cover those lost wages. Economic damages can also cover projected future losses, such as the long-term costs of your medical care and rehabilitation, as well as projected loss of future income due to an accident-related disability.
  • Non-economic damages are a subjective measure of a plaintiff’s real (but difficult to measure) losses. What If I’m Found Partly Responsible for My Injuries?

A common question many accident victims have is, “What if I was partially at-fault for what happened? Can I still sue the other party for damages?” The answer is “yes.” Oregon follows what is known as a modified comparative negligence rule in personal injury cases, which means that even if the plaintiff was partly responsible for their injuries, they are often still able to recover some damages from a negligent defendant.

Comparative negligence basically means that a court will apportion fault for an accident among all of the responsible parties, including the plaintiff. This apportionment is done on a percentage basis. The court will then determine the total amount of the plaintiff’s damages and reduce them based on their percentage of fault.

For example, say a plaintiff and a defendant are involved in a car accident. The plaintiff sues the defendant for damages. The defendant argues the plaintiff actually caused the accident. After hearing the evidence, the jury decides the defendant was 70 percent at-fault and the plaintiff was 30 percent at-fault. If the plaintiff’s total damages from the accident was $100,000, the defendant would only have to pay $70,000 of that amount.

However, Oregon does bar a plaintiff from recovering any damages if their share of the fault exceeds 51 percent. So if the jury found the plaintiff was 70 percent at-fault, the defendant would not have to pay anything at all.

How Long Do I Have to File a Personal Injury Claim?

All lawsuits must be filed within a period of time known as the statute of limitations. In Oregon, the statute of limitations with respect to personal injury claims is generally two years. This means that from the date of an accident, you have 2 years to identify and sue the responsible parties.
